The contract stipulated between "acquerellidautore.it" and the Customer must be considered concluded with the acceptance, even if only partial, of the order by "acquerellidautore.it". This acceptance is considered tacit, unless otherwise communicated in any way to the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions.

The sales contract between the customer and acquerellidautore.it is understood to be concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this distance selling contract, if the Customer is a Consumer, the territorial jurisdiction is that of the reference court of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Treviso.

the purchaser is strictly prohibited from entering false data, from third parties or invented, in the registration procedure necessary to activate the procedure for the execution of this contract. acquerellidautore.it reserves the right to legally prosecute any violation and abuse, in the interest and for the protection of all consumers.

NOTE: the issue of the Sales Invoice can be requested during the order phase (by ticking the appropriate box) or no later than the date of fulfillment of the same; after this date it can no longer be requested.

 

All prices are inclusive of VAT, net of transport costs and commissions.

 

The goods always travel at the risk and peril of the recipient. acquarellidautore.it is not responsible for any problem and/or delay due to the courier used for shipping.

Upon receipt of the package, check that:

• the package is intact, not damaged or wet, and in any case compliant with the standard characteristics of a package
• the number of packages indicated on the invoice corresponds to the number of packages actually delivered.

Any disputes must be immediately raised to the carrier:

• expressing a control reserve, i.e. the package is accepted, but before signing the document you will have to write "I accept with the right to reserve" and the reason for this reserve; in this case it will be possible, once the package is opened, to check for any damage;
• rejecting the damaged goods if it is not possible to accept them with reserve rights, or if the damage is still visible without the need to open the package.

The Customer who receives damaged goods and signs with the right of reserve, must notify the Acquerellidautore.it company within 3 days, by mail with delivery advice or by registered letter with return receipt (with acknowledgment of receipt) to the address: Felice Feltracco - Via Malombra, 75 - 31011 Asolo (TV) indicating "DAMAGED GOODS" in the subject line, and then follow the directions.

The Customer who receives defective goods must notify it within 14 days by sending an email (with delivery notice) to info@acquerellidautore.it and attaching photos proving the defect found; subsequently, and always by e-mail, the instructions to follow for the return will be sent. Following receipt of the goods defined as defective, the company acquerellidautore.it, after having meticulously checked the material, will provide indications on the exchange. The costs of redelivery for the replacement of the product will be borne by acquerellidautore.it

Any shipment of material must be authorized by the company acquerellidautore.it.

In the absence of complaints, the product is considered delivered correctly.

 

RIGHT OF WITHDRAWAL

 

Pursuant to Legislative Decree 206/05 (Consumer Code) the right of withdrawal can be exercised by the Consumer Customer (i.e. a natural person who does not make the purchase by indicating a VAT number in the order form) within 14 working days from receipt of goods, with full refund of the amount paid.

To return the goods making use of the right of withdrawal, the Customer must send a registered letter with return receipt (with acknowledgment of receipt) to the address: Felice Feltracco - Via Malombra, 75 - 31011 Asolo (TV), within 14 days from the date of receipt of the goods, indicating in the subject "REQUEST FOR RIGHT OF WITHDRAWAL" and all the data of the sale (sender, invoice number and/or order number, goods to be returned).

Once the registered letter with which the Customer communicates his/her intention to exercise the right of withdrawal has been received, the Acquerellidautore.it Company, having verified that the above requirements are met, will authorize the return of the goods by mail.

The Customer will have to arrange for the shipment of the goods

• at their own expense;
• taking care of the packaging to avoid damage during transport (the material must be made intact in all its parts, including external and internal packaging; the Customer is fully responsible for the goods sent for return);
• within 3 days of receipt of the return authorization notice.

Upon receipt, the company acquerellidautore.it will check the integrity of the goods and the original internal and external packaging. If the goods or part of the returned goods, or one of the original internal or external packaging, is damaged or missing, the company acquerellidautore.it will not proceed with the refund and the goods will be returned to the Customer with the charge of the new shipping costs.

Once the goods have been received and the necessary checks have been carried out, the company acquerellidautore.it will proceed

• the issue of a Credit Note for an amount equal to the value of the returned goods
• to refund the Credit Note within 30 days.

It will be the Customer's responsibility to promptly provide all the data necessary for receipt of the refund due.

 

The right of withdrawal cannot be exercised in the following cases:

• after 14 days from the date of receipt of the goods;
• purchase of made-to-measure or clearly personalized goods
• goods refused at the time of delivery (NOTE: in this case the customer will be refunded the amount paid less storage and return costs)

We consider the information relating to your person, your orders and purchases made by you strictly confidential and we undertake not to disclose or sell the information in our possession to external companies for promotional purposes.

The personal data requested in the registration phase are collected by acquerellidautore.it and processed on IT supports, in order to satisfy the obligations arising from the contract concluded with the Customer and will not be transferred to third parties under any circumstances or for any reason. watercolorsauthor.it guarantees its customers compliance with the legislation on the processing of personal data, governed by the "Code regarding the protection of personal data" pursuant to Legislative Decree 196/03. We will use the data you provide us exclusively for the purpose of communicating information, news and promotions of our materials.

The customer, at any time, has the right to revoke consent to the processing of personal data with written communication to be sent by e-mail or by post to the headquarters of acquerellidautore.it.
